Kestrel Technology ("KT" or "Kestrel") is committed to protecting the privacy of individuals who visit our web site ("Visitors"), or individuals who register to obtain our information or downloadable products ("User" or "Users"). This Privacy Statement describes KT’s privacy practices in relation to the use of our web site and web site-enabled products or services.

Information We Collect

Kestrel Technology uses Google Analytics to collect visitor data and analyze traffic on our site. This information helps us understand customer interests and helps us improve our web site. When you visit our site, the pages that you look at, and a short text file called a cookie, are downloaded to your computer. A cookie is used to store small amounts of information. This information is collected for traffic analysis only. The cookie does not contain personal details. Depending on the browser that you use, you can set your preferences to block or refuse cookies, or to notify you before they are stored. Kestrel Technology collects personally-identifiable information only from Users who elect to use our web site to request additional information about the company, or from Users who decide to order and download available licensed products. Accordingly, KT will request User self-identifying information in these two described cases. Additionally, in order to form a proper software license with an identifiable counter-party for those products requiring a license, and to comply with USA export rules, KT will request that the User self-identify his name, organizational affiliation (if any), complete physical address, nationality, and telephone number(s). Lastly, KT does not knowingly collect information from, or direct any of our web site content specifically to, children or teenagers under the age of 18. If we learn or suspect that a registered User is under the age of 18, we will promptly delete any personal information in that User’s name, and seek to rescind any voidable licenses that may have been erroneously granted.

How We Use the Information We Collect

KT will retain User-provided self-identification information within its structured database systems for use and periodic reference by authorized KT personnel. KT will use the information to prove the existence of enforceable license agreements and report sales of licensable products or services. Unless the self-identification information was intended for KT follow-on purposes, as stated in the web site form at the time of submission, KT will not use the information to initiate follow-on contact for the purposes of selling additional products or services. KT will not employ third party marketing agents to engage in follow-on sales attempts. KT may contact Users to inquire of their quality of experience with KT products or services. Users may volutarily follow Company activities on social media sites, but KT will not use these connections to initiate follow-on direct sales attempts.

How We Share the Information We Collect

Unless compelled to do so by court order or administrative agency subpoena, KT will not share the information provided by Users with anyone other than employees of Kestrel Technology, its board of directors, or its legal or tax advisors.

Gathering and Protecting the Information We Collect

Kestrel Technology will only gather the information that Users choose to provide by using this web site and associated order forms and download buttons. KT will keep User-provided information on its contact database, and electronically stored Product files that are password protected for authorized KT personnel. KT cautions that it will take reasonable and not extraordinary measures to protect its electronic storage systems, but does not warrant that such systems or measures are perfect.

Compelled Disclosure

As stated above, Kestrel Technology will reveal User-provided information only in response to a court order or administrative agency subpoena to do so, upon good cause shown.

Your Access to and Control of Information We Collect

As a past or current User, you are entitled to know what information we have collected about you. Upon written request, and once your identity is verified, we will confirm to you what information we possess and retain about you. You have no right to control this information, as it is collected for our limited business purposes to enable software license administration and financial reporting. You do not have direct access to this information once provided by you, but we can and will confirm what information we retain.

Changes to this Privacy Statement

Kestrel Technology reserves the right to change its web site and Privacy Policy from time to time, in its sole discretion. If we do so, we will send a notice of material changes to this Privacy Policy by sending a written notice to the physical address identified by the User and by posting a Notice of Change on our home page to this web site.
